What are Taxes?

Did you know that the Constitution obliges everyone to pay taxes?

This stems from the content of Article 84 of the Constitution of the Republic of Poland (of April 2, 1997).


Taxes are an integral part of our lives, influencing every aspect of our daily lives - from purchases to wages. Understanding what taxes are is the foundation for better navigating the world of finance and law.

What is a tax?

A tax is a public law, gratuitous, compulsory, and non-refundable monetary payment to the State Treasury, voivodeship, county, or commune, resulting from a tax law (Article 6 of the Tax Ordinance).



...In simpler terms?

The easiest way for me to explain it is based on the content of the provision:


  • monetary payment - we can only pay taxes in this form.


  • to the State Treasury, voivodeship, county, or commune (hereinafter referred to as the State) - only "they" can receive money from taxes. Depending on the type of tax, the money may go to different institutions. For example, PCC goes to the appropriate mayor of the city or village where we live.


  • public law - this means that we do not need a separate agreement with the City Mayor or the President of Poland. The obligation to pay taxes arises from the law introduced by the state.


  • gratuitous - we cannot expect or demand anything in return from the State for paying taxes.


  • compulsory - we are forced to pay taxes. Otherwise, the tax authorities may enforce the claim through various means of coercion, which I will write more about in the future.


  • non-refundable - we cannot count on a refund of the tax paid, unless we have overpaid or paid less than we should have.



Basic types of taxes

Taxes can be divided into several main categories:


  1. Income taxes - such as PIT (personal income tax) and CIT (corporate income tax), which we pay on our income.


  2. Indirect taxes - such as VAT (value added tax), which we pay with every purchase.


  3. Property taxes - such as property tax or inheritance and gift tax.


  4. Local taxes - fees for the commune, such as property tax or market fee.

Understanding what taxes are and what their types are is key to managing your finances consciously and better understanding state mechanisms.
